The debate over the determination of death has been raging for more than fifty years. Since then, objections against the diagnosis of brain death from family members of those diagnosed as dead-have been increasing and are causing some countries to take novel steps to accommodate people’s beliefs and preferences in the determination of death. This, coupled with criticism by some academics of the brain death criterion, raises some questions about the issues surrounding the determination of death. In this paper, we (...) discuss some of the main approaches to death determination that have been theoretically proposed or currently put into practice and propose a new approach to death determination called "weak pluralism" as a reasonable ethical and political alternative to respect diversity in death determination. Se ha procedido a comparar las políticas sociales relacionadas con la Educación para la Salud promulgadas en los territorios españoles según algunas metas establecidas en la Agenda 2030. Mediante un análisis comparativo con el software Atlas.ti versión 22, se han obtenido los resultados, evidenciando que las políticas sociales están sufriendo una transformación pero con (...) diferencias. Requiring family authorization for apnea testing subtracts health professionals control over death determination, a procedure that has traditionally been considered a matter of clinical expertise alone. In this commentary, we first provide evidence showing that health professionals’ (HPs) disposition to act on death determination without family’s prior consent could be much lower than that referred to by Berkowitz and Garrett (2020). We hypothesize that HPs may have reservations about their own expertise as regards death, and may thus hesitate to impose (...) their views on patients’ families. We then address the theoretical question of clinical expertise in death determination by distinguishing judgments about facts (e.g., the presence or absence of spontaneous breathing) from interpretations given of these facts (i.e., their meaning for the vital status of an individual). We argue that, while clinicians may claim some expert authority on the former, they hold no particular authority on the latter. (shrink)

Este trabajo persigue reflexionar sobre el estatuto ontológico de la comunidad en base a la figura de Nietzsche como arcano de la apuesta teórica tiqquniana. Así, a partir de las consideraciones que Nietzsche realiza sobre la vida, junto con los diagnósticos que Tiqqun despliega a partir de su _metafísica crítica_, se explorarán algunos de los pliegues del pensamiento de ambos autores tratando de iluminar una cartografía de la no pertenencia que sustituya la lógica identitaria de la comunidad moderna fundamentada en (...) el principio de humanismo. Dicha cartografía no solo persigue agotar el lenguaje político contemporáneo, sino que piensa en una forma política y comunitaria desarrollada desde el _pathos_ de la distancia, el éxtasis y la filosofía política an-árquica. El esfuerzo teórico aquí recogido ilumina y teje la presencia de Nietzsche en el pensamiento de Tiqqun manifestando el anhelo compartido entre ambos autores por desatar prácticas de libertad en la tarea de traer al mundo las vidas que aún están por venir. In this paper, it is our purpose to argue for a processual conception of ill-person- identity. To do so, we will review some of the main answers that philosophy has given to the question of personal identity. We will review certain proposals on how to conceive illness and ill-person-identity, as well. Within the frame of a processual approach to ontology, we will focus on a non-dualistic processual-relational interpretation of biological organisms.

El presente trabajo trata de demostrar, en primer lugar, que el enfoque “gnoseológico” de la pregunta por la ciencia defendido por Gustavo Bueno corresponde en rigor únicamente al materialismo gnoseológico, la teoría propuesta por Bueno, mientras que el adecuacionismo, el teoreticismo y el descripcionismo serían teorías de la ciencia que genuinamente adoptarían el enfoque “epistemológico”. En segundo lugar, se sostiene que los enfoques epistemológico y gnoseológico se generan en la alternativa planteada por el dualismo cartesiano alma/cuerpo, pues mientras el primero (...) concibe al sujeto que hace las ciencias como una mera mente que opera con proposiciones o conceptos “sobre las cosas”, el segundo lo entiende como un cuerpomecánico que construye las ciencias operando “con las cosas mismas”. Puesto que en Descartes es el alma la instancia que conoce, la opción por el cuerpo del materialismo gnoseológico explica su posición al margen de la cuestión del conocimiento. Por último, se examinan algunos problemas que esta noción cartesiana del sujeto conlleva para la concepción de las “ciencias humanas y etológicas” del materialismo gnoseológico.This work tries to demonstrate, in first place, that the “gnoseological” approachto the question for the science defended by Gustavo Bueno in fact only fits in thegnoseological materialism, the theory proposed by Bueno, while adequationism, theoreticism and descriptionsm would be theories of the science that genuinely would adopt the “epistemological” approach. In second place, we sustain that the epistemological and gnoseological approaches are generated in the soul/body alternative outlined by Cartesian dualism, because while the first one conceives the subject that makes the sciences as a mere mind that operates with propositions or concepts “about the things”, the second one understands it as a mechanical body that builds the sciences operating “with the things themselves”. Since in Descartes the soul is the instance that knows, the option for the body of the gnoseologicalmaterialism explains its positioning regardless of the question ofknowledge. Lastly, we examine some problems that this Cartesian notion of subject implicates for the gnoseological materialism’s conception of “human and ethological sciences”. (shrink)

Background: This research explores how public awareness and attitudes toward donation and transplantation policies may contribute to Spain's success in cadaveric organ donation. Materials and Methods: A representative sample of 813 people residing in Andalusia (Southern Spain) were surveyed by telephone or via Internet between October and December 2018. Results: Most participants trust Spain's donation and transplantation system (93%) and wish to donate their organs after death (76%). Among donors, a majority have expressed their consent (59%), and few nondonors have (...) expressed their refusal (14%). Only a minority are aware of the presumed consent system in force (28%) and feel sufficiently informed regarding the requirements needed to be an organ donor (16%). Participants mainly consider that relatives should represent the deceased's preferences and be consulted when the deceased's wishes are unknown, as is the case in Spain. Conclusion: Public trust in the transplant system may contribute to Spain's high performance in organ donation. High levels of societal support toward organ donation and transplantation do not correspond with similar levels of public awareness of donation and transplantation policies in Spain. (shrink)

Altruism and solidarity are concepts that are closely related to organ donation for transplantation. On the one hand, they are typically used for encouraging people to donate. On the other hand, they also underpin the regulations in force in each country to different extents. They are often used indistinctly and equivocally, despite the different ethical implications of each concept. This paper aims to clarify to what extent we can speak of altruism and solidarity in the predominant models of organ donation. (...) It also raises the ethical question of whether these categories are adequate as a basis for such models, bearing in mind that organs are a scarce resource and that a shortage of them may mean that fewer lives are saved or improved. This paper analyses the arguments for and against what we have called automatic organ procurement model in relation to the organs of the deceased. For this purpose, this work provides empirical evidence to assess the potential impact of this model on donation rates and on public opinion. Specifically, we examine first the reasons supporting this model, with special reference to utilitarian and justice arguments. On the other hand, we analyse both the approaches based on the violation of pre mortem and (...) post mortem interests opposing this theoretical model and the rejection the model would generate in the population. Finally, we point out the aspects that, in our opinion, should be exhaustively regulated if this model were implemented. In particular, we refer to the legal status of the human body, the treatments for end-of-life patients, the incentives for health professionals and the recognition of the right to conscientious objection. Organ shortage constitutes an unsolved problem for every country that offers transplantation as a therapeutic option. Besides the largely implemented donation model and the eventually implemented market model, a theorized automatic organ procurement model has raised a rich debate in the legal, medical and bioethical community, since it could show a higher potential to solve organ shortage. In this paper, we study the main arguments for and against this model. We show how, in the light of empirical data extracted from (...) countries with a universal health care system, its implementation could lead to a positive impact on organ procurement rates. Three factors are envisioned as fundamental in the comprehension and a possible regulation of the automatic organ procurement model: the lack of recognition of the conscientious objection, the preservation of the right to choose end of life conditions, and the need to avoid incentives for families or healthcare professionals. This article considers the relationship between phenomenology and behaviorism in a new perspective. First, we present the phenomenological approach of the Spanish philosopher Ortega y Gasset (1883–1953). Ortega’s perspective involves a transformation of classical phenomenology in a direction that emphasizes ‘life as action’ and ‘historical reason’ as a form of explanation. These aspects of Ortega’s approach are of interest to contemporary phenomenology, and enable phenomenology’s relationship with behaviorism to be reconsidered. Second, we present Skinner’s radical behaviorism, the (...) variant of behaviorism most relevant to phenomenology. Of particular importance here is radical behaviorism’s emphasis on final causality and its approach to ‘private events’ in terms of the interpersonal functions served by these events. Third, we propose a mutual correction, both of behaviorism by phenomenology and of phenomenology by behaviorism, in which behaviorism’s notion of the environment may better be conceptualized through the phenomenological notion of the ‘lived-world,’ and phenomenology could adopt radical behaviorism’s dialectical and constructivist perspective. ESPAÑOL: Aunque Aristóteles llegó a calificar como «revolución» el cambio violento de las politeias griegas y Arendt, al revisar el uso moderno del término, ve a ésta como el surgimiento de una inevitable y desconocida forma de gobierno que, a través también de la violencia, busca la libertad e igualdad política de todos los ciudadanos, fue Ortega quien se atrevió a aseverar que lo menos esencial de las revoluciones es la violencia, apuntando con ello a la aparición de un (...) discurso y una narrativa que quebranta y modifica nuestra percepción del mundo. Sin embargo, a pesar de mantener dicha intención quebrantadora, el discurso revolucionario parece haberse convertido en ciertas zonas de Latinoamérica en un arte factus lingüístico —término que usó también Ortega— que sirve a la concentración del poder y la ideología ( en el sentido usado por Teun van Dijk) de un grupo social específico. ENGLISH: Although Aristotle came to qualify as a «revolution» violent change of the Greek polity and Arendt, reviewing the modern use of the term, sees this as the emergence of an inevitable and unknown form of government, also through violence, seek freedom and political equality of all citizens, was Ortega who dared to assert that the least essential of revolutions is the violence, pointing to the emergence of this discourse and narrative breaks and changes our perception of the world. However, despite this intention to keep disruptive, revolutionary discourse seems to have become in parts of Latin America in a language factus art — a term also used by Ortega — serving concentration of power and ideology (in the sense used by Teun van Dijk) of a particular social group. A lo largo de la tradición psicopatológica, incluso de la pre-fenomenológica, se encuentra la categorización del delirio como creencia. Jaspers asumió ese uso y lo fundó fenomenológico-existencialmente, definiendo su carácter de convicción. El concepto de creencia ha tenido un largo recorrido dentro de la historia del pensamiento, aunque recientemente se ha intensificado el debate acerca de la visión doxástica del delirio. En virtud de lo ya mencionado, en el presente artículo presentamos un análisis conceptual de la creencia, con el objetivo (...) de identificar de manera precisa los aspectos esenciales que permiten al delirio definirse según ella. De esta manera, se discutirán algunas de las principales incursiones realizadas en el concepto desde la antigüedad periplatónica hasta José Ortega y Gasset, remarcando en cada pensador las directrices esenciales de su aproximación a la creencia. A su vez, introducir al filósofo español al debate psicopatológico permitirá incluir en la discusión dos aspectos importantes que creemos pueden ser fructíferos para la discusión filosófica sobre el delirio: la diferencia entre ideas y creencias, y la vitalidad de estas últimas. Finalmente, hacemos referencia al actual debate pro- y antidoxástico, haciendo hincapié en la necesidad de considerar la amplitud del concepto de creencia en su genealogía histórica. Con base en ello estaríamos en condición de acercarnos a la visión doxástica moderada que han defendido autoras como Lisa Bortolotti. (shrink)

Vivir en la periferia, entonces, tenía limitaciones que el tiempo no subsana. Internet es hoy una posibilidad, cierto, pero también encubre, mistifica, mantiene a la conciencias individuales en su atomicidad sedente. Es su función ideológica y política, mientras se incrementan aquellas limitaciones. Aquella periferia tenía, al menos, la excusa (...) de la ‘dictadura’. Eran tiempos de lecturas frenéticas y de emociones intensas pero «vacías», sin horizontes ni concepto. Había otras ciudades, otros jóvenes, incluso entre nosotros. Había ya quienes se agrupaban, quienes leían a Marx, quienes viajaban y, sobre todo, quienes sufrían. (shrink)

Con este análisis pretendemos investigar tanto las bondades o perjuicios de la técnica en la sociedad como, sobre todo, la posibilidad de salvaguardar la humaneidad en un mundo aparentemente dirigido por ella. Con este motivo, haremos uso de los tres autores que en opinión propia han conseguido patentizar los efectos que la técnica ostenta (...) en el modo de ser de lo humano de una manera clara y original: Husserl, Heidegger y Ortega y Gasset. This year we celebrate Raimon Panikkar’s centenary; one of the most important Spanish thinkers and, undoubtedly, one of those who had the widest international repercussion, together with the other three big philosophers of the 20th century: Unamuno, Ortega and Zubiri. The present work explores the relationship between his thinking and Xabier Zubiri’s, a well-known thinker in the History of Spanish Philosophy, and that of Amor Ruibal, a Galician thinker not so wellknown outside specialized circles. This connection among the three (...) thinkers lies particularly in a conception of reality marked by the relation, reaching its culmination in the Catalan-Hindu thinker: The cosmotheandric perspective of Raimon Panikkar, Zubiri’s respectivity and radical relativity, and the ontological relativity or universal correlationism of Amor Ruibal. According to resemblance nominalism, things have their properties in virtue of resembling other things. This unfashionable view is championed with clarity and rigor.

ObjectivesThe aims of this research were to compare the levels of physical activity of eHealth users and non-users, to determine the effects of these technologies on motivations, and to establish the relationship that could exist between psychological constructs and physical activity behaviors.MethodsThis cross-sectional study involved 569 adults who responded to an online questionnaire during confinement in France. The questions assessed demographics, usage of eHealth for exercise and physical activity, and behavioral levels. The questionnaire also measured the constructs of Social Cognitive (...) Theory, the Theory of Planned Behavior, and automaticity facets toward eHealth for exercise and physical activity.ResultsParticipants who were users of eHealth for exercise and physical activity presented significantly higher levels of vigorous physical activity and total physical activity per week than non-users. The chi-square test showed significant interactions between psychological constructs toward eHealth and physical activity levels. Self-efficacy was significantly and negatively correlated with walking time per week. Concerning the automaticity facets, efficiency was positive and significantly correlated with vigorous physical activity levels per week. Then, regressions analyses showed that self-efficacy and automaticity efficiency explained 5% of the variance of walking minutes per week and vigorous physical activity per week, respectively.ConclusionThis study has shown that people during confinement looked for ways to stay active through eHealth. However, we must put any technological solution into perspective. The eHealth offers possibilities to stay active, however its benefits and the psychological mechanisms affected by it remains to be demonstrated: eHealth could be adapted to each person and context. The ethics of deceased organ procurement (OP) is supposedly based on individual consent to donate, either explicit (opt-in) or presumed (opt-out). However, in many cases, individuals fail to express any preference regarding donation after death. When this happens, the decision to remove or not to remove their organs depends on the policy’s default option or on family preferences. Several studies show that in most countries the family plays a significant and often decisive role in the process of decision-making for OP. (...) Depending on the country, the family may be allowed to take different kinds of actions in different situations, and this may be granted either by law or by clinical practice only. This adds much complexity to the usual classification of consent policies in two categories: opt-in and opt-out. Here we propose a novel and comprehensive taxonomy of the models of consent for OP according to three variables: (1) the deceased’s wishes, if any, (2) family wishes, if any, and (3) default policies. By analysing these models of consent, we show that they rely on at least three different concepts of autonomy: individual autonomy, relational autonomy, and family autonomy. In light of this analysis, we discuss the ethical debates surrounding two policy approaches: presumed consent and family veto. (shrink)

The classification of preserved hypothalamic activity in brain death and brainstem death as functional or non-functional has become a subject of debate. While proponents of the neurological criterion claim that these activities lack functional significance (Shemie et al. 2014), Nair-Collins and Joffe (2023) argue for their functional physiological role. However, the interpretation of the term "function" within the medico-legal framework, where death is characterized by the irreversible cessation of all brain functions, remains unclear. -/- My intention here is not to (...) engage in a debate over the validity of different viewpoints regarding the functional significance of preserved activities in the hypothalamus or the heart. Rather, I aim to highlight the critical importance of exploring and defining the concept of function in medicine, which currently lacks clarity. My point is that, whatever our position in the brain death debate, reaching a consensus on this conceptual matter would minimize misunderstandings and establish a robust foundation for further insightful analysis. But nothing could be further (...) from the truth. The articles were of such density and their content of such profundity that it took months of interpretation and study, and of bringing my own knowledge up to date, before I was in a position to understand the concepts, adjust my beliefs, and make some comments. I could certainly have delivered some kind of eulogy about the brilliance of their content; I might have countered with my own article. However, what seemed most coherent to me was to meet their arguments head on and deal with what I consider to be their principal weaknesses, leaving the bouquets for the end.The articles set out, as I understand them and within the clinical context, to relate phenomenology, in its most traditional form, with the most current form of Skinnerian behaviorism, situating themselves in a contextualism that is, at the same time, close to and removed from the most radical type of social constructionism.But let us begin by looking more closely at “Phenomenology and Behaviorism.” It is novel for me, though Professor Pérez-Álvarez had already proposed it several years ago (Pérez-Álvarez 1992), to view operant behavior as intentionality, or at least as involving final causality according to the Aristotelian classification. It is a surprising contention, not least because, as I recall, Skinner lived in a time and a context (historical reason) in which the basic goal of psychology was to convert itself into a natural science, comparable in all respects to physics, which it took as a model, focusing therefore on efficient causality (also according to Aristotle’s terminology), so that behavior was considered as the immediate consequence of a stimulus, and the stimulus–response association became the cornerstone of the discipline. It is true that the operant behavior concept refers to the functional relationship between behavior and reinforcement, but it is no less true that Skinner’s definition of reinforcement is totally empirical—“all that which increases or decreases the probability”—meaning that reinforcement can be considered neither as a motive nor as a reason for behavior, unless it be in the eyes of the observer. [End Page 251]Furthermore, even though Yela (1987) refers to Ortega y Gasset’s formula “I am myself and my circumstances” as a Skinnerian approach, the truth is that Yela himself argues that it is precisely the self that constitutes personality, such that I have a personality because I am me, and not vice versa, as Skinner would appear to argue. In this regard, Ortega’s celebrated formula has generally been interpreted, from the most personalist perspectives, as “the circumstances are myself”—to highlight the denial of the psychological subject by radical behaviorism (Mischel’s [1968] criticism of the concept of personality is relevant here). On top of this, Skinner’s rejection of all that was not directly observable, or at least, that could not be operationalized, calls into question the admissibility of anything called final cause or intentionality of behavior. In his philosophy, all the indications are that contingencies are what determine behavior; and that there would be no room for a structural causality, as Althusser would argue, or of a reciprocal determinism, in Bandura’s terms, or even of an interaction between subject and environment, as modern interactionists would maintain. “I am myself and my circumstances” seems in Skinner to become “the circumstances are me”, and indeed, the reinforcement history – which in the article in question is considered as something akin to the Sartrian idea of “life project” – is for Skinner nothing more than a continuous association of events. In my view, Ortega’s perspectivism would perhaps be closer to the sociology of the American action theorists, Merton, Parsons, etc., than to Skinnerian behaviorism, since “action”—as the action theorists... In this paper two deductive systems associated with relevance logic are studied from an algebraic point of view. One is defined by the familiar, Hilbert-style, formalization of R; the other one is a weak version of it, called WR, which appears as the semantic entailment of the Meyer-Routley-Fine semantics, and which has already been suggested by Wójcicki for other reasons. This weaker consequence is first defined indirectly, using R, but we prove that the first one turns out to be an (...) axiomatic extension of WR. Moreover we provide WR with a natural Gentzen calculus. It is proved that both deductive systems have the same associated class of algebras but different classes of models on these algebras. The notion of model used here is an abstract logic, that is, a closure operator on an abstract algebra; the abstract logics obtained in the case of WR are also the models, in a natural sense, of the given Gentzen calculus. This work gives a new argument for ‘Empirical Philosophy of Mathematical Practice’. It analyses different modalities on how empirical information can influence philosophical endeavours. We evoke the classical dichotomy between “armchair” philosophy and empirical/experimental philosophy, and claim that the latter should in turn be subdivided in three distinct styles: Apostate speculator, Informed analyst, and Freeway explorer. This is a shift of focus from the source of the information towards its use by philosophers. We present several examples from philosophy of mind/science (...) and ethics on one side and a case study from philosophy of mathematics on the other. We argue that empirically informed philosophy of mathematics is different from the rest in a way that encourages a Freeway explorer approach, because intuitions about mathematical objects are often unavailable for non-mathematicians. This consideration is supported by a case study in set theory. (shrink)
